Terms of Service

These Terms of Service apply to all services including website creation, web/mobile applications, custom software, and associated maintenance, provided by RaceUp to its clients.

• Online orders: the Client builds their project with the website configurator; the fixed price for the selected scope is displayed before any payment. The order is confirmed once these Terms are accepted and the 40% deposit is paid online.
• Custom projects: quotes are provided free of charge, valid for 30 days. The order is confirmed upon receipt of the signed quote + 40% deposit.
• A kick-off call defines the project scope and schedule with the Client. If the Client cancels the order before the project kick-off, the deposit is refunded in full.
• Modifications requested by the Client result in an amendment billed at the hourly rate (€50 excl. tax/hour).

• Website/app/software creation: Design, development, testing, deployment.
• Maintenance: Bug fixes, updates, backups.

Revisions: 2 iterations included; additional iterations billed separately.

Fixed price excl. tax (VAT not applicable, art. 293 B CGI). Staggered payment: 40% deposit, 40% on beta validation, 20% on production deployment. The deposit is paid online by card through the secure Stripe payment platform; subsequent instalments can be paid online from the client area. An invoice is issued for each payment. Terms: 30 days net, no discount.

In accordance with article L221-18 of the French Consumer Code, consumer Clients have 14 days from the order to withdraw, without giving any reason, by notifying RaceUp by email. If they expressly requested that the service start before the end of this period, they remain liable for the amount corresponding to the service provided until they communicate their withdrawal (article L221-25). This right does not apply to business clients.

All rights (source code, designs, databases) remain the exclusive property of RaceUp until full payment. Transfer of ownership + perpetual license after final settlement.

Both parties commit to the confidentiality of information exchanged. RaceUp processes Client data as a GDPR sub-processor.

Disputes: Commercial Court of Reims. Applicable law: French.
